The International Journal of Therapeutic Jurisprudence

This is the inaugural issue of the International Journal of Therapeutic Jurisprudence, a journal produced by Arizona Summit Law Review. It provides a collection of student, academic, and practitioner articles on the topic of Therapeutic Jurisprudence ("TJ"). Therapeutic Jurisprudence is a way of looking at "law as therapy" or "therapy through law.” It grew out of mental health law and the scholarly writings of Professor David Wexler in the late 1980's. Its applications have expanded into all areas of the law since then. This journal attempts to capture just of few of the many applications of TJ. This Journal is somewhat of a hybrid between a typical law review journal and a journal on social sciences. Its mission is to publish practical material that engages and influences both the legal and scientific communities. Specifically this issue presents fifteen articles ranging from practitioners' use of TJ principles, TJ applications in criminal sentencing and restoration, to mainstream applications of TJ and procedural justice.

Piyyut de David Hassine

Le siècle des lumières n'a pas encore atteint son apogée en Europe et la renaissance de la langue hébraïque patientera encore un siècle avant que des œuvres inspirées du mouvement de la Haskala ne voient le jour. Pourtant, au Maroc, un poète juif du XVIIIe siècle, David Hassine (né à Meknès en 1722 et mort en 1792) plongeant ses racines dans les profondeurs de la Torah et de l'exégèse biblique, héritier de la tradition culturelle et cultuelle de l'âge d'or espagnol, compose pour ses contemporains, et surtout, pour son Créateur, des piyyutim, poèmes liturgiques chantés, dans un hébreu vivant, riche et mélodieux. Le piyyut était d'abord un ornement à la prière, puis il est peu à peu intégré dans le rituel religieux pour agrémenter et animer les cérémonies publiques ou privées. Tel un faisceau de rayons lumineux, prenant leurs sources à travers les siècles et qui convergent vers un point focal, ainsi dans les piyyutim se concentrent une science, un savoir, une culture, une philosophie et une densité spirituelle plusieurs fois millénaires, à transmettre dans la continuité des générations. Cette forme littéraire a pris une place prépondérante dans la culture juive marocaine qui est restée fortement enracinée dans la tradition judéo-espagnole tant sur le plan juridique que culturel et littéraire. David Hassine est une des figures les plus connues de la poésie liturgique juive marocaine et ses piyyutim ont été diffusés à travers le monde séfarade. Il a en effet voué sa vie au piyyut. Il y chante, prenant Dieu à témoin, les petites et les grandes joies, les solennités, les douleurs et les drames d'une communauté dont il se fait l'écho harmonieux et passionné, écho de cet espoir bimillénaire du retour à Sion.
