The Foundations of International Investment Law

Bringing Theory into Practice

International investment law is one of the fastest growing areas of international law. It has led to the signing of thousands of agreements, mostly in the form of investment contracts and bilateral investment treaties. Also, in the last two decades, there has been an exponential growth in the number of disputes being resolved by investment arbitration tribunals. Yet the legal principles at the basis of international investment law and arbitration remain in a state of flux. Perhaps the best illustration of this phenomenon is the wide disagreement among investment tribunals on some of the core concepts underpinning the regime, such as investment, property, regulatory powers, scope of jurisdiction, applicable law, or the interactions with other areas of international law. The purpose of this book is to revisit these conceptual foundations in order to shed light on the practice of international investment law. It is an attempt to bridge the growing gap between the theory and the practice of this thriving area of international law. The first part of the book focuses on the 'infrastructure' of the investment regime or, more specifically, on the structural arrangements that have been developed to manage foreign investment transactions and the potential disputes arising from them. The second part of the book identifies the common conceptual bases of an array of seemingly unconnected practical problems in order to clarify the main stakes and offer balanced solutions. The third part addresses the main sources of 'regime stress' as well as the main legal mechanisms available to manage such challenges to the operation of the regime. Overall, the book offers a thorough investigation of the conflicting theoretical positions underlying international investment law, testing their worth by reference to concrete issues that have arisen in the jurisprudence. It demonstrates that many of the most important practical questions arising in practice can be addressed by a carefully dosed resort to theory.

The International Journal of Therapeutic Jurisprudence

This is the inaugural issue of the International Journal of Therapeutic Jurisprudence, a journal produced by Arizona Summit Law Review. It provides a collection of student, academic, and practitioner articles on the topic of Therapeutic Jurisprudence ("TJ"). Therapeutic Jurisprudence is a way of looking at "law as therapy" or "therapy through law.” It grew out of mental health law and the scholarly writings of Professor David Wexler in the late 1980's. Its applications have expanded into all areas of the law since then. This journal attempts to capture just of few of the many applications of TJ. This Journal is somewhat of a hybrid between a typical law review journal and a journal on social sciences. Its mission is to publish practical material that engages and influences both the legal and scientific communities. Specifically this issue presents fifteen articles ranging from practitioners' use of TJ principles, TJ applications in criminal sentencing and restoration, to mainstream applications of TJ and procedural justice.

Handbook of Research on Teaching the English Language Arts

Now in its fourth edition, the Handbook of Research on Teaching the English Language Arts – sponsored by the International Literacy Association and the National Council of Teachers of English – remains at the forefront in bringing together prominent scholars, researchers, and professional leaders to offer an integrated perspective on teaching the English language arts and a comprehensive overview of research in the field. Reflecting important developments since the publication of the third edition in 2010, this new edition is streamlined and completely restructured around "big ideas" in the field related to theoretical and research foundations, learners in context, and new literacies. A companion website extends and enhances the Handbook with a wealth of additional resources. The Handbook of Research on Teaching the English Language Arts, Fourth Edition: Addresses all of the language arts within a holistic perspective (speaking/listening, language, writing, reading). Is well grounded and balanced in theory and research while promoting validated practice. Features authors who are known for their expertise and who represent diversity in culture, years in the profession, and geographic location. Gives attention to special populations and instructional contexts. Includes new media literacies. Has the authority of a research handbook while remaining practical for students in masters and doctoral classes.

Impacts of International Research on Intertemporal Yield Stability in Wheat and Maize

An Economic Assessment

It is difficult to generate any watertight account of declines in yield variability at
the aggregate level that can be attributed to any specific research program. But
the evidence is strong nonetheless that yield variability has declined with the
diffusion of modern wheat varieties, and possibly also with maize. As reported by
previous researchers, there has factually been a decline in the variability of
national-level wheat yields and, to a lesser extent, maize yields. This decline has

History and Context in Comparative Public Policy

Douglas E. Ashford joins a growing number of scholars who have questioned the behavioralist assumptions of much policy science. The essays in this volume show why policy analysis cannot be confined to prevailing methods of social science. Policy-making behavior involves historical, contextual, and philosophical factors that also raise critical questions about the concepts and theory of the discipline. Ashford asks difficult questions about the contextual, conjunctural, and unintentional circumstances that affect actual decision-making. His bridging essays summarize opposing viewpoints and conflicting interpretations to help form a new agenda for comparative policy analysis.

Multi-Agent Systems for Concurrent Intelligent Design and Manufacturing

Agent Technology, or Agent-Based Approaches, is a new paradigm for developing software applications. It has been hailed as 'the next significant breakthrough in software development', and 'the new revolution in software' after object technology or object-oriented programming. In this context, an agent is a computer system which is capable of acting autonomously in its environment in order to meet its design objectives. So in the area of concurrent design and manufacturing, a manufacturing resource, namely a machine or an operator, may cooperate and negotiate with other agents for task assignment; and an existing engineering software can be integrated with a distributed integrated engineering design and manufacturing system. Hence in agent-based systems, there is no centralized system control structure, and no pre-defined agenda for the system execution, as exist in traditional systems. This book systematically describes the principles, key issues, and applications of agent technology in relation to concurrent engineering design and manufacturing. It introduces the methodology, standards, frameworks, tools, and languages of agent-based approaches and presents a general procedure for building agent-based concurrent engineering design and manufacturing systems. Both professional and university researchers and postgraduates should find this an invaluable presentation of the corresponding theories and methods, with some practical examples for developing multi-agent systems in the domain.
